حرية التقاضي عند أهل الذمة في ضوء فقه النوازل ـــ نازلة فقهاء قرطبة أنموذجا ـــ

الملخص
يعالج البحث موضوع حرية التقاضي عند أهل الذمة من خلال فقه النوازل بالغرب الإسلامي، وقد جاء تناولي له في مقدمة وثلاثة مسائل: أما المقدمة؛ فعرجت فيها على مصطلحات الدراسة بالتعريف والبيان وهي: (حرية التقاضي، أهل الذمة، النوازل). أما المسألة الأولى، فخصصتها لعرض النازلة المعروفة بنازلة فقهاء قرطبة، والتي تدور حول اختلاف يهودي ويهودية بقرطبة على التقاضي عند المسلمين أو اليهود. أما المسألة الثانية، فبينت فيها بعض الأدلة الشرعية الداعمة لمبدأ حرية التقاضي عند أهل الذمة، وجواز استقلالهم عن المسلمين قضائيا. أما المسألة الثالثة والأخيرة، فأبرزت من خلالها بعًضًا من مظاهر حرية التقاضي عند أهل الذمة، من خلال نازلة فقهاء قرطبة، وبعض النوازل الفقهية المماثلة. This research deals with the topic of freedom of litigation among the people of the Dhimmah through the fiqh of contemporary incidents of islam in the west. I : deal with the topic in an introduction and three parts In the definition, I try to define some key words like freedom of litigation, the .people of the dhimmah, and the fiqh of contemporary issues The first part is devoted to the well known issue of the jurists of Cordoba, which revolves around the despute that took place between two jews : a man and a woman. The dispute was about whether they would litigate their issue at .Muslim or Juish courts In the second part I show, with evidence from Shariaa law, that the people of the dhimmah were free to litigate their lawsuits wherever they wanted and that .they were autonomous from Muslim judicial system The third and final part highlights some of the aspects of freedom of litigation among the peolpe of the dhimmah. The issue of the jurists of Cordoba and other .similar issues are presented as case studies
