فتاوى النوازل الطبيّة المعاصرة ومدى اعتبارها لفقه الموازنات. (فتوى نازلة إجهاض الأجنة المشوّهة أنموذجا)

الملخص
الملّخـــــــــــــــــــــــــص تتناول هذه الدراسة بشقّيها النظري والتطبيقي تفصيل القول في فتوى نازلة علمية تعتبر من أهمّ النوازل الطبية التي تتعلّق بالمرأة في الوقت الحاضر, والمتمثلة في نازلة "إجهاض الأجنّة المشوّهة" كتطبيق للجانب النظري لفقه الموازنات. والذي كان مفاده الإجابة على الإشكال التالي: ما المقصود بفقه الموازنات وما أهمّ صوره وقواعده, ثمّ ما مدى اعتبار هذا الفقه في حسم النزاع في فتوى نازلة إجهاض الأجنّة المشوّهة؟ وقد انتظم البحث بعد المقدّمة في قسمين: قسم التصوّرات (النظري): حيث تحرير المقصود بحقيقة الفتوى والمراد بمسمى النوازل, وماهية فقه الموازنات باختصار, وأصل مشروعيته, ثمّ أهمّ صوره وقواعده. قسم التّصديقات (التطبيقي): حيث الانتقال من ميدان التنظير والتأصيل إلى واقع التطبيق والتنزيل, وذلك بالتمثيل الفقهي لفقه الموازنات من خلال عرض فتوى نازلة إجهاض الأجنّة المشوّهة, بذكر حقيقة الإجهاض وتقسيماته, وأسباب التشوهات واضطرابات نمو الأجنّة, ثمّ توصيف النازلة من خلال عرض الموقف الطبّي وبعده الموقف الشرعي, ومن ثمة الإحالة على ميزان المصالح والمفاسد, والموازنة بينهما بناءا على القواعد الشرعية المقررة, لنصل إلى معرفة مدى اعتبار الفقهاء لميزان فقه الموازنات في الفتوى الخاصة بالنّازلة. لنختم البحث بنظم أهمّ النتائج المتوصل إليها وإيراد جملة من التوصيات. الكلمات المفتاحية: النوازل الطبيّة _فقه الموازنات_ المصالح والمفاسد_ الاجهاض_ الأجنّة المشوّهة. Abstract This study has handled in tow sides theoretical and pratical the detailed speech in the comes down that is an important medical science issues concerning women at the present time. It represented in « the abortion of deformed embryos » ;This study is an application of the theoretical side of Fikh Al-Mowazannat, which was to answer the folloqing problem : What is Fikh Al-Mowazannat ? And what is the most important forms and rules of it ? And how did Fikh Al-Mowazannat to resolve the difference in the fatwa of Abortion of Aeformed Embryos ? And the resaerch was organized after an introduction in tow sections : The theoretical side : where the statement of the concept of Al-Fatwa and Nawazzil ; and the definition of Fikh Al-Almowazannat ; and its origin of legitimacy. The pratical side : where transition from the field of endoscopy and rooting to the reality of applicaytion and download where the representation of Fikh Al-Mowazannat in fatwa of Abortion of Aeformed Embryos, To mention the concept of Abrotion anh its divisions, and causes of abnormalities and developmental disorders of fetuses, Then presented the medical situation and after it the legitimate position, Then referral to the balance of interests and evil – Masallih and Mafassid – and balance between them according to the prescribed rules of legimacy to reach to know the extent of Al-Fokahae consider the balance of Fikh Al-Mowazannat in the fatwa on the humiliation.
