الملخص
نود في هذا البحث التكلم حول ما يحمل صفة المقدسات عند غير المسلمين ونبين الموقف الإسلامي منها، ثم نذكر الموقف الفقهي والقانوني، والإشكالية الرئيسية التي يود الباحثان الإجابة عنها: ما هو الموقف الشرعي نحو المقدسات عموما ضمن أنظمة تتغطى بالأطر القانونية الداعية للحريات والممارسات الدينية؟، وما هو الموقف القانوني الدولي حولها المقدسات والإساءة لها؟؛ وقد استعنا في بحثنا على المنهج الاستدلالي كما استعنا بالمنهج التحليلي للنظر والتحليل والاستنتاج، وقد حاولنا تحرير مصطلح (المقدس) وحصره ضمن نطاقه الصحيح فيما يخدم بحثنا، إضافة إلى التأصيل الشرعي للمقدسات الروحية والمحسوسة مع ذكر ما جاء في القوانين الدولية حول المقدسات، وخلصنا إلى أن الموقف الشرعي يتميز بتفصيلات حول الموضوع نظرا لتغير الأحوال والظروف، أما الموقف القانوني فإنه يؤسس لدبلوماسية التعامل الدولي بتغليب قوة السياسة والنفوذ على الاتفاقيات الدولية محاولة لكسب جميع الأطراف ضمن قانون الأمم المتحدة. الكلمات المفتاحية: المقدسات؛ الموقف الشرعي؛ الموقف القانوني؛ الحرية الدينية؛ الحضارات. Abstract: We would like in this research to talk about the sanctity of what holds the status of sanctity when non-Muslims and indicate the Islamic position around it, then mention the jurisprudence and legal position, and the main problematic that the researchers would like to answer: What is the legitimate attitude towards sanctity in general covered by legal systems advocating religious freedoms and practices? What is the international legal position on sanctities and their abuse, we have used in our research on the evidentiary approach and the analytical approach to consideration, analysis and conclusion. we have finally shown the attempt to liberate the term (sacred) and confine it within its proper scope in the world of terminology. we have concluded that the legitimate position is characterized by details on the subject due to changing circumstances and circumstances. the legal position tries to calm all parties by taking precedence over the power of politics and influence over international conventions.
