الاستثمار المالي: دراسة شرعية وقانونية في آليات التنمية والحماية

الملخص
نبحث في هذه الورقة البحثية عن آليات التنمية والحماية للاستثمار في الشريعة الإسلامية والقانون الوضعي، نتعرض إلى هذا الموضوع بالنقد والتثمين والتوجيه إلى ما يحقق المصلحة المرجوة في حفظ كلية من مقاصد الشريعة ألا وهي حفظ المال؛ وقد تطرقنا إلى الدراسة بجوانب عدة فذكرنا نظرة الشريعة الإسلامية للاستثمار وكيف أسست للسلوك الاستثماري؛ وعرجنا بعد ذلك إلى تعريفات الاستثمار المعاصرة والقديمة، ثم التوصيف الفقهي لأهم آليات الاستثمار كالوادائع والصكوك والصناديق الاستثمارية؛ ثم ذكرنا آليات تنمية الاستثمار وحمايته من المنظور الشرعي والقانوني؛ وخلصنا في الأخير إلى أنَّ الاستثمار مطلب شرعي على الحاكم لحماية أموال الأمة وتوسيع مواردها؛ والعمل على تحيين آلياته في كل مرة واجب من قبيل التجديد ومواكبة التغييرات الاقتصادية. Abstract: Financial investment: a legitimate and legal study of development and protection mechanisms We look in this research paper on the mechanisms of development and protection of investment in Islamic law and positive law, we are exposed to this subject with criticism, valuation and guidance to what achieves the desired interest in preserving the whole of the purposes of Sharia, namely the preservation of money; we have touched on the study in several aspects, Then the Fiqh description of the most important investment mechanisms such as deposits, instruments and investment funds; then we mentioned the mechanisms of investment development and protection from the legitimate and legal perspective; and finally concluded that investment is a legitimate demand on the ruler to protect the nation's funds and expand its resources; and work to update its mechanisms every time a duty such as renewal and keep pace with economic changes.
