الحماية الدولية للأطفال المشاركين في العمليات القتالية وإشكالية المسؤولية الجنائية الدولية

الملخص
تنامت ظاهرة اشتراك الأطفال في العمليات القتالية وتفاقمت معها انتهاكات حقوق الطفل، مما يستدعي اعتماد القواعد القانونية لحظر تجنيد الأطفال وحمايتهم أثناء النزاعات المسلحة ومحاسبة المسؤولين عن تجنيدهم، لكن بالرغم من كل الجهود التي بذلت لحمایة الأطفال المقاتلين، إلا أن آثار معاناتهم مازالت كارثية، ولعل خير دليل على ذلك النماذج المتعددة لانتهاك حقوق الأطفال على مستوى العالم بأسره سواء بشأن مشاركتهم في القتال أو بشأن وقوعهم أسرى في قبضة العدو، وقد توصنا إلى عدة نتائج منها أن حماية الأطفال المشاركين في القتال من أولويات المواثيق الدولية، وأن الانتهاكات التي يتعرض لها الأطفال بسبب تجنيدهم تستدعي مساءلة القادة العسكريين أمام المحكمة الجنائية الدولية Violations of children's rights have increased due to the phenomenon of children's participation in hostilities,This is what led to the adoption of legal rules to prohibit the recruitment of children and their protection during armed conflicts and to hold accountable those responsible for their recruitment,However, these efforts were not sufficient to stop the suffering of children and its catastrophic effects, and this is evidenced by the multiple forms of violations of children's rights worldwide,Whether it is related to the participation of children in the fighting or their being captured by the hostile forces.Accordingly, we concluded as results that the protection of children participating in the fighting is one of the priorities of international conventions,And the violations that children are exposed to because of their recruitment calls for the accountability of military leaders before the International Criminal Court.
