الملخص

كرس المؤسس الدستوري الجزائري قاعدة توزيع الإختصاص التشريعي بين السلطتين التشريعية والتنفيذية ، فخول للحكومة سلطة المبادرة بالقوانين إلى جانب أعضاء البرلمان. إلا أن التنظيم الدستوري والقانوني لهذين الاختصاصين لم يكن على النحو الذي يقتضيه مبدأ الفصل بين السلطات، حيث كرس تفوق سلطة على حساب الأخرى، فجعل من صاحب الإختصاص الأصيل مقيد، وفتح المجال أمام الحكومة ، مما أثر سلبا على مكانة البرلمان. The present research paper revolves around the Algerian constitutional founder who set the rule of distributing legislative competence between the legislative and executive authorities. The former has authorised the government to initiate laws alongside members of parliament. Nonetheless, both the constitutional and legal organisation competences were not required by the principle of separation of powers, since it established the superiority of one authority at the expense of the other. On the same line of thought, the enrichment of the original jurisdiction is restricted, and the way is opened to the government, which negatively affected the position of Parliament.
