التوسع في نظرية التفويض و الحالات المستحدثة لتبرير استخدام القوة

الملخص
تعالج هذه الورقة البحثية موضوع استخدام القوة في العلاقات الدولية بعد الحرب الباردة، وكيف خرج من نطاقه القانوني المحدد في ميثاق الأمم المتحدة. وتبين الورقة أن استخدام القوة العسكرية في إطار القانون الدولي عملية محددة المعنى وواضحة المعالم ضمن الفصل السابع من الميثاق الأممي، لكن هذا الاستخدام أصبح يتم أكثر فأكثر في إطار سياسي، وأصبح معه مفهوم الشرعية يخضع لتفسير ذاتي يتوافق مع مصلحة مستخدم القوة. وتؤكد الممارسة الميدانية الفعلية لبعض القوى الدولية الفاعلة مثل الولايات المتحدة الأمريكية وفرنسا، ما آل إليه واقع استخدام القوة، حيث مافتئت تلك الدول تستغل قوتها ونفوذها، وتتوسع بشكل مستمر في نظرية التفويض الضمني من طرف مجلس الأمن، لتبرير استخداماتها المتكررة وغير القانونية للقوة ضد الدول، خاصة عندما يتعذر عليها استصدار قرارات صريحة بذلك . Abstract: This article deals with the issue of the use of force after the Cold War, and how it became incompatible with its legal scope defined in the Charter of the United Nations. The article shows that the use of military force within the framework of international law is a specific and clearly defined process within Chapter VII, but this use is increasingly taking place within a political framework, and therefore the concept legitimacy is subject to self-interpretation in the interest of the user of force. The actual practice on the ground of certain active international powers, such as the United States of America and France, confirms the reality of the use of force. These powerful actors are harnessing their power and influence, and constantly expanding the theory of tacit authorization by the Security Council, to justify the illegal use of force against states.
