حدود الاستقلالية الممنوحة للسلطات المختصة بضبط المجال الاقتصادي والمالي

الملخص
من أجل قيام سلطات الضبط الاقتصادي بممارسة وظيفة مراقبة القطاعات الاقتصادية والمالية بما يتماشى والتوجه القائم على التخلي عن التسيير المباشر والمركزي لهذه النشاطات الحساسة والتقنية، كان لا بد من منحها استقلالية تجعل منها كيانا مؤسساتيا قائما بحد ذاته وقادر على تحقيق الأهداف التي أدت إلى ظهوره. هذه الخاصية التي تعتبر الركيزة الأساسية التي تقوم عليها فعالية ونجاعة العملية الضبطية برمتها لم تصل لدرجة الاكتمال، نظرا لتدخل السلطة التنفيذية في الجانب الوظيفي والعضوي الذي يحكم هذه الاستقلالية، الأمر الذي أفرغ هذه الميزة من محتواها الحقيقي وجعل منها مجرد استقلالية شكلية موجهة نحو الاستهلاك الخارجي. Abstract: In order to exercise for the economic regulatory authoritie the supervisory function of the economic and financial sectors in accordance with the trend based on the abandonment of direct and central management of these sensitive and technical activities, it is necessary to grant them independence to make it an independent institutional body entity capable of achieving the objectives that led tohis appearance. This characteristic, which is the main pillar on which the effectiveness and efficiency of the entire control process is based, has not reached the point of completion, considering the intervention of the executive authority in the functional and organic aspect that governs this Independence, which has emptied this feature of its real content and made it a mere formal independence directed towards external consumption.
