مجلس المنافسة بين الواقع و النصوص

الملخص
يهدف هذا البحث إلى التعريف بمجلس المنافسة كسلطة إدارية مستقلة وتحديد دوره في مجال الضبط الاقتصادي في ظل تكاثر سلطات الضبط وتوسعها إلى قطاعات اقتصادية جديدة يحكمها جميعا مبدأ المنافسة، بما أدى إلى تقاطع اختصاصات المجلس مع بعض السلطات الإدارية الأخرى العاملة في المجال الاقتصادي، وهو ما يتطلب ضرورة التنسيق والتعاون بينهم حتى لا يؤدي تدخل إحداها إلى التناقض مع أخرى. ومن أهداف هذا البحث التقصي عن الصعوبات التي تعيق مجلس المنافسة في طبعته الجزائرية والثغرات والنقائص التي تشوب النصوص القانونية المتعلقة به، وأخيرا المساهمة في اقتراح بعض الحلول والأفكار التي تدعم دوره وتقوي مركزه القانوني من أجل المساهمة في بعث الاقتصاد الوطني. This research aims to introduce the Competition Council as an independent administrative authority and to determine its role in the field of economic control in light of the proliferation of control powers and their expansion into new economic sectors governed by all the principles of competition, which has led to the intersection of the council's terms of reference with some other administrative authorities, which requires the need for coordination and cooperation between them so that the intervention of one does not lead to a contradiction with others. One of the objectives of this research is to investigate the difficulties that hinder competition law in its Algerian edition, gaps, and shortcomings, and finally to contribute to the proposal of some solutions and ideas that support its role and strengthen its legal status.
