خصوصية عقود الشراكة و آلية تحقيق نجاعتها بين القطاع العام والخاص

الملخص
الملخص: يعتبر القطاع الخاص من الركائز الأساسية في الاقتصاد والتنمية في البلدان المتجهة للتطوير، ومن أهم الدعائم المهمة للقطاع العام في توفير الخدمات للمجتمع بشكل عام، حيث تعد عقود الشراكة من أهم الطرق والأساليب التي تلجأ لها الإدارة في تنفيذ المشاريع التنموية و الخدماتية، حيث يعد تعريف هذا النوع من العقود بأنّها الاتفاق بين الإدارة وشركات القطاع الخاص من أجل المشاركة في إنشاء أو تنفيذ أو إدارة المشاريع الخدمية ومشاريع البنى التحتية. يتميز هذا النوع من العقود بصفتها الهجينة من حيث مدى اعتبارها من العقود الخاصة أو العقود الإدارية من جهة ، والطبيعة المركبة من جهة أخرى حيث تتكون من عدة عقود متداخلة في آن واحد، حيث تتناول هذه الدراسة الطبيعة القانونية لهذه العقود والرقابة عليها خصوصا في الدول التي تأخذ بنظام القضاء المزدوج ، ومنها فرنسا، على خلاف ما هو قائم في الدول التي تأخذ بنظام القضاء الموحد على سبيل المثال الولايات المتحدة الأمريكية وبريطانيا. Abstract: The private sector is considered one of the main pillars of the economy and development in the developing countries, and one of the most important pillars of the public sector in providing services to society in general. Where partnership contracts are one of the most important ways and methods that the administration resorts to in the implementation of development and service projects, where the definition of this type of contract is the agreement between the administration and private sector companies in order to participate in the establishment, implementation or management of service projects and infrastructure projects. This type of contract is distinguished as a hybrid in terms of the extent to which it is considered a private contract or an administrative contract on the one hand, and the complex nature on the other hand, as it consists of several overlapping contracts at the same time; Where this study deals with the legal nature of these contracts, especially in countries that adopt a dual justice system, including France, unlike what exists in countries that adopt a unified judicial system, for example, .the United States of America and Britain
