الملخص

ملخص: إنّ قاعدة التيسير تُعتبر واحدة من دعائم الفقه الكلّية التي تعكس سماحة الشريعة الإسلامية، ويتخرّج عليها جميع رُخَص الشرع وتخفيفاته في مختلف الأبواب. وإنّني أهدف من خلال هذا البحث إلى تسليط الضوء على تجلّيات هذه القاعدة الكبرى في أحكام المناسك النصّية والاجتهادية، واستعراض أهمّ شواهدها وبراهينها، وإبراز ملامحها وشاراتها. دون أن أُغفِل بيان الأهمية الوظيفية التي تكتسيها القاعدة في المستجدات والنوازل المعاصرة المتعلّقة بهذا الباب، إلى جانب رسم المعالم الصحيحة والواضحة لضمان حسن تطبيقها. Abstract: The rule of facilitation is considered one of the pillars of the overall jurisprudence that reflects the tolerance of Islamic law, and all the licenses and mitigations of the law in various chapters come out of it. I aim through this research to shed light on the manifestations of this major rule in the provisions of textual and jurisprudential rituals, and to review its most important evidence and proofs, and to highlight its features and signs. Without neglecting the statement of the functional importance of the rule in the contemporary developments and calamities related to this section, in addition to drawing the correct and clear features to ensure its proper application.
