مجلس المنافسة كآلية لترقية وحماية مبدأ حرية المنافسة في الجزائر

الملخص
نهدف من خلال الورقة البحثية التي بين أيدينا إلى تشخيص دور مجلس المنافسة، باعتباره سلطة ضبط مستقلة جاءت لتغطي الانسحاب التدريجي للدولة من السوق والحفاظ على النظام العام الاقتصادي داخل الأسواق، وذلك بما خوّله له المشرّع الجزائري من صلاحيات استشارية وأخرى ردعية. وقد خلصت هذه الدراسة فيما يخص حصيلة نشاطات مجلس المنافسة ؛ إلى غياب هذه الحصيلة خلال السنوات من 1995إلى غاية 2013 وضعف رصيدها بين سنوات 2013 إلى 2018، وبداية نشاطه المكثف سنتي 2019 و 2020. وخاتمة حاولنا ومن خلالها تلخيص جملة من التوصيات و الاقتراحات. We aim through the research paper in our hands to diagnose the role of the Competition Council, as an independent control authority that came to cover the gradual withdrawal of the state from the market and the preservation of public economic order within the markets, with the advisory and other deterrent powers granted to it by the Algerian legislator. This study concluded with regard to the outcome of the activities of the Competition Council; Due to the absence of this outcome during the years from 1995 to 2013 and the weakness of its balance between the years 2013 to 2018, and the beginning of its intensive activity in the years 2019 and 2020. In conclusion, we tried to summarize a number of recommendations. and suggestions
