المحكمة الدستورية في الجزائر -دراسة في التشكيلة والاختصاصات-

الملخص
هدفت هذه الدراسة إلى إلقاء الضوء على المحكمة الدستورية الجزائرية باعتبارها أحد أهم العناصر الجديدة التي جاء بها التعديل الدستوري2020، وذلك من خلال بيان مكانتها وطبيعتها القانونية، كذلك تشكيلتها وأهم الشروط التي دعمت بها من طرف المؤسس الدستوري، خصوصا تلك المتعلقة بكيفية اكتساب العضوية داخل المحكمة الدستورية وضمانات استقلاليتها، بالإضافة إلى توسيع اختصاصات هذه المؤسسة، وتوصلت الدراسة إلى أن وجود المحكمة الدستورية في الجزائر، وإناطة مهمة الرقابة على دستورية القوانين بها، يعد تطورا دستوريا وديمقراطيا مهما، ولذا فإنه يلزم الحفاظ على هذه المحكمة وعلى اختصاصاتها والعمل على تنفيذ أحكامها، لاسيما أحكامها بعدم الدستورية في مواجهة السلطات العامة في الدولة، إعلاء للشرعية الدستورية وضمانا لحقوق الأفراد وحرياتهم. Abstract: This study aimed to shed light on the Algerian Constitutional Court as one of the most important new elements introduced by the Constitutional Amendment of 2020. That is through demonstrating its status and legal nature, As well as its composition and the most important conditions that the constitutional founder supports it with, especially those related to the way of acquiring membership within the Constitutional Court and those that guarantee its independence. In addition to expanding the jurisdictions of this institution. The study found that the existence of the Constitutional Court in Algeria and the mandate to monitor the constitutionality of laws is an important constitutional and democratic development. Therefore, it is necessary to preserve this court and its jurisdictions and to work on implementing its provisions, especially those of unconstitutionality in the face of public authorities in the State, in order to uphold constitutional legitimacy and guarantee the rights and freedoms of individuals.
