الحماية الدولية لضحايا جرائم الاتجار بالبشر

الملخص
ملخص : تعد جريمة الاتجار بالبشر من الجرائم الخطيرة العابرة للحدود الدولية التي تمثل شكلا من أشكال الاسترقاق المعاصر، حيث تتخذ من الإنسان سلعة تباع وتشترى في مقابل جني الأرباح المالية أو تحقيق أغراض معينة، عن طريق استدراج الضحايا بطرق ووسائل عديدة لاستخدامهم في أغراض الدعارة والاستغلال الجنسي، وبيع الأعضاء البشرية والعمل والزواج القسري، وبيع الأطفال....الخ. بناء عليه يسلط هذا المقال الضوء على دراسة حقوق ضحايا جريمة الاتجار بالبشر في الاتفاقيات والمواثيق والبرتوكولات الدولية، ومدى كفايتها من اجل مساعدتهم وحمايتهم وإعادة تأهيلهم من جهة، وإنجاح الملاحقة الجنائية لمرتكبي الجريمة من جهة أخرى، خاصة أمام حقيقة التعامل السائد مع الأشخاص المتجر بهم على أنهم مجرمين مخالفين للقوانين والتشريعات الداخلية وليسوا ضحايا. الكلمات المفتاحية : جرائم الاتجار بالبشر؛ ضحايا الاتجار بالبشر؛ حقوق ضحايا الاتجار؛ الحماية الدولية. Abstract: The crime of trafficking in human beings is a serious transnational crime that represents a form of contemporary slavery, whereby a person is a commodity sold and bought in exchange for financial profits or the achievement of certain purposes, by soliciting victims in many ways and means for their use in prostitution and sexual exploitation, and selling Human organs, work, forced marriage, sale of children, etc. Accordingly, this article highlights a study of the rights of victims of trafficking in human beings in international agreements, charters and protocols, and their adequacy in order to assist, protect and rehabilitate them on the one hand, and the success of the criminal prosecution of the perpetrators of the crime on the other hand, especially in front of the reality of the prevailing treatment with trafficked persons as Criminals who violate internal laws and regulations and are not victims.
