مقارنة بين جريمة تهريب المهاجرين و جريمة الاتجار بالبشر دراسة قانونية في ظل الاتفاقيات الدولية و قانون العقوبات الجزائري

الملخص
نصت اتفاقية الأمم المتحدة لسنة2000 على أحكام و بنود تجبر الدول الأعضاء فيها على مكافحة الجريمة المنظمة العابرة للحدود الوطنية، و قد الحق بهذه الاتفاقية بروتوكولين آخرين ، الأول جرم تهريب المهاجرين و الثاني جرم الاتجار بالبشر، حيث ألزمت الدول الأطراف، اعتماد نظام قانوني داخلي ينص على مكافحة هاتين الجريمتين،و تعتبر الجزائر ،من الدول التي اعتمدت مثل هذه التشريعات، حيث جاء القانون 09_01 المعدل لقانون العقوبات الجزائري، للنص على هاتين الجريمتين وعلى العقوبات المقررة لهما، فما هي أهمية التفرقة بين الجريمتين؟ و كيف يمكن التمييز بينهما؟ La convention des nations unies de 2000 a stipulé des articles obligent les états membres à travailler sur la lute contre la criminalité organisée ;transnationale ;cette convention a été relie par deux protocoles ,le premier a incriminé le trafic de migrants et le deuxième a incriminé le traite des êtres humains ;ce qui oblige les nations unies partis convention une états juridiques internes pour lutter contre ces deux crimes ;et l’Algérie et l’un des premiers pays qui ont adopté une telle législation, par la loi 09_01 modifie le code pénale de prévoir ces crimes et les peines prescrites . quel ‘est la différence entre les deux crimes ? The United nations convention of 2000 provided on clauses and rules, which oblige member states to fight organized crime across national borders. Two other protocols have been added ,the first incriminated smuggling of migrants and the second incriminated the trafficking in human beings, so That member states have been committed to adopt internal legal system states to combat these crimes. And Algeria is one of countries which has adopted such legislation, where the law 09_01 amending the Algerian penal code come to texted on these crimes and the punishments prescribed. So what is the difference between the two crimes ?
