The Multiateral Treaty Reservation Revisited (vandenberg Reservation)

Abstract
ABSTRACT: the multilateral treaty reservations have destructive effect on the compulsory jurisdiction system, chiefly because the broad conception of interpretation of the “affected” States bars proceedings before the Court over disputes as to multilateral treaties concluded by a larger group of States, if not all the States party to the treaty are also parties in the proceedings before the Court. As for the other part of the reservation, that stipulation virtually invalidates the obligations assumed in declarations of acceptances, since it hampers the Court to deal with a dispute submitted to it unless the State making such a reservation in its declaration or, on the basis of reciprocity, the adverse party has agreed to the Court’s jurisdiction. ملخص باللغة العربية: تحفظ الفاندنبرغ قدمته الولايات المتحدة الأمريكية لدى محكمة العدل الدولية تريد من خلاله في قادم الأيام وبخصوص اي نزاع بينها وبين دولة أخرى يطرح امام المحكمة أن لا تحكم المحكمة في حالة نظرها النزاع وفق المعاهدات المتعددة الأطراف كالميثاق مثلا، كل ذلك للتضييق على محكمة العدل الدولية وكذا التسبب في بطء الاجراءات بخصوص النظر في القضية ومن ثم الفصل فيها، أو الزام المحكمة باللجوء إلى المصادر الأخرى، وهذا الذي حدث في نزاع نيكاراغوا سنة 1984 عندما رفعت هذه الأخيرة دعوى ضد الولايات المتحدة الأمريكية تطالبها فيها بالتعويض عن الانتهاكات التي قامت بها من زرع للألغام وتدمير لعدة موانئ، بالاضافة إلى تدريب جماعة الكونترا، وهو عمل ينتهك قواعد القانون الدولي عامة، والقانون الدولي الانساني خاصة، غير أن أمريكا دفعت بتحفظ الفاندنبرغ للتنصل من التزاماتها، وهو ما حدث فعلا في يوم 1991.09.26.
