الملخص
تناولت هذه الدراسة موضوع حماية الاصناف النباتية وفق التشريع الجزائري ووفق منظومة الملكية الفكرية و كذا وفق نظام اتفاقية تريبس وتوضيح العناصر الاساسية التى يجب أن يتضمنها النظام الفريد الفعال الخاص بحماية الاصناف النباتية الجديدة .بداية من تحديد المقصود بالصنف النباتي الجديد المشمول بالحماية وتحديد شروط استحقاقه للحماية القانونية بدء بالشروط الموضوعية ، وصولا إلى خصوصية وذاتية إجراءات إيداعه وطلبه وكيفية فحصه والهيئات المنوطة بذلك الفحص وذلك من خلال التفصيل في شروطه الشكلية . This study deals with the issue of protecting plant varieties according to the Algerian legislation and according to the intellectual property system, as well as according to the system of the TRIPS Agreement, and clarifying the basic elements that must be included in the unique effective system for the protection of new plant varieties. Starting with the objective conditions, reaching the privacy and subjectivity of the procedures for depositing and requesting it, how it is examined, and the bodies entrusted with that examination, through detail in its formal conditions.
