الملخص
يناقش هذا البحث حدود تأثير فيروس كورونا المستجد على الالتزامات التعاقدية لعقود التجارة الدولية، وذلك وفقاً لأحكام الهيئات والمنظمات التشريعية الخاصة بالتجارة الدولية خاصة منها اتفاقية الامم المتحدة في العقود للبيع الدولي للبضائع 1980 ومبادئ الينيدروا 2016. وبالموازاة مع ذلك تطرح الدراسة تساؤل رئيسي حول مدى إمكانية تنفيذ الالتزامات التعاقدية لعقود التجارة الدولية في ظل إشكالية تكييف جائحة كورونا كعائق أو قوة قاهرة. وانعكاسات ذلك على التجارة الدولية والاقتصاد العالمي بشكل عام. وقد تم الخروج بجملة من النتائج أهمها أنه يمكن إعتبار فيروس كورونا المستجد عائقاً أو قوة قاهرة، وذلك استنادنا لما جاء في مضامين أحكام الهيئات المعنية، وهذا ما سوف يترتب عليه آثار قانونية واقتصادية على الالتزامات التعاقدية للعقود التجارية الدولية المختلفة. Abstract: This research discusses the limits of the impact of the emerging corona virus on the contractual obligations of international trade contracts, in accordance with the provisions of legislative bodies and organizations for international trade, especially the United Nations Convention on Contracts for the International Sale of Goods 1980 and the principles of Unidroit 2016. In parallel, the study raises a major question about the extent of the possibility of implementing Contractual obligations to international trade contracts in light of the problem of adapting the Corona pandemic as a constraint or force majeure. And its implications for international trade and the global economy in general. We have come out with a set of results, the most important of which is that the new Corona virus can be considered an obstacle or a force majeure, based on what was stated in the contents of the provisions of the relevant bodies, and this will have legal and economic implications for the contractual obligations of the various international commercial contracts.
