أحكام تصرفات الطفل المالية بين القانون المدني الجزائري و الفقه الإسلامي

الملخص
Abstract: The financial actions of the child have different provisions included in the civil law, and the provisions of Islamic Fiqh have shown them, from among the behaviors that the boy engages in financial actions, and the child may initiate them when he is distinguished for this case. Then I was exposed to the sections of the financial actions, so it is easier for me after that to clarify the ruling for each of them separately, and the difference mentioned regarding these provisions between the civil law and the family law, and then I reached the results I mentioned at the end of this research. Abstract: Les actions financières de l'enfant ont différentes dispositions incluses dans le droit civil, et les dispositions de la Jurisprudance islamique les ont montrées, parmi les comportements que le garçon engage dans des actions financières, et l'enfant peut les initier lorsqu'il se distingue pour cette affaire. Ensuite, j'ai été exposé aux sections des actions financières, il est donc plus facile pour moi de clarifier la décision pour chacune d'entre elles séparément, et la différence mentionnée concernant ces dispositions entre le droit civil et le droit de la famille, puis j'ai atteint les résultats que j'ai mentionnés à la fin de cette recherche. ملخص: تصرفات الطفل المالية لها أحكام مختلفة شملها القانون المدني وبينتها أحكام الشريعة الإسلامية، من جملة التصرفات التي يباشرها الصبي التصرفات المالية و قد يباشرها الطفل حينما يكون مميزا لهذه الحالة أحكام قانونية تختلف عما إذا كان غير مميز وأقدم على نفس التصرف، لذلك عرفت التمييز بادئ الأمر، ثم تعرضت لأقسام التصرفات المالية ليسهل علي بعد ذلك تبيان حكم كل تصرف منها على حدة، والإختلاف الوارد بخصوص هذه الأحكام بين القانون المدني وقانون الأسرة، ثم وصلت لنتائج أوردتها في ختام هذا البحث.
