الضمانات القانونية والآليات المؤسساتية لحماية المواطنة الإدارية في الجزائر : دراسة مسحية

الملخص
تحظى المواطنة الإدارية في الجزائر بمجموعة من الضمانات القانونية والآليات المؤسساتية التي تعمل على تفعيل قيمها، ففيما يخص الضمانات القانونية يتعلق الأمر بالأسس الدستورية انطلاقا من دساتير 1963، 1976 و1989 والتعديلات الدستورية اللاحقة، أو تعلق الأمر بالأسس التشريعية خاصة من خلال قوانين البلدية والولاية، أو الأسس التنظيمية خاصة المرسوم 88-131 المنظم للعلاقات بين الإدارة والمواطن، أما فيما يتعلق بالآليات المؤسساتية فهي تنقسم إلى آليات ذات علاقة مباشرة مع حماية قيم المواطنة الإدارية من خلال خاصة محافظة الإصلاح والتجديد الإداريين، هيئة وسيط الجمهورية، الوزارة المنتدبة المكلفة بإصلاح الخدمة العمومية،الوزارة المنتدبة لدى الوزير الأول المكلفة بإصلاح الخدمة العمومية، المرصد الوطني للمرفق العام، أو من ناحية المؤسسات ذات العلاقة غير المباشرة مع حماية المواطنة الإدارية كاللجنة الاستشارية لترقية حقوق الإنسان وحمايتها والمجلس الوطني لحقوق الإنسان. Administrative citizenship in Algeria enjoys a range of legal guarantees and institutional mechanisms that give effect to its values, Legal guarantees relate to constitutional foundations, starting with the 1963 constitution, 1976 and 1989 and subsequent constitutional amendments, it also relates to legislative basis in particular through municipal and prefecture laws, or regulations in particular the decree of 88-131 regulating relationships between the administration and the citizen, and with regard to the institutional mechanisms, they are divided into mechanisms directly related to protection of the values of citizenship administrative through by the commission of Reform and Renewal administrative, The Mediator of the Republic, the Ministry delegate in charge of reforming the public service, the ministry delegated to the Prime Minister in charge of Public Service Reform, The National Observatory of Public Utilities, Or the relevant institutions with indirect protection of the administrative citizenship, such as the Advisory Commission for the Promotion and Protection of Human Rights and the National Human Rights Council.
