الرقابة القضائية على دستورية القوانين- المحكمة الدستورية العليا المصرية نموذجا-

الملخص
أقرّ المشرع الدستوري المصري إنشاء هيئة قضائية مستقلة تسمى المحكمة الدستورية العليا والتي أوكل إليها مهمة الرقابة على دستورية القوانين واللّوائح، حيث يهدف الباحث من خلال هذه الدراسة الوقوف على مدى فعالية آليات الرقابة التي تمارسها المحكمة الدستورية العليا في ضمان إحترام مبدأ سمو الدستور وحماية الحقوق والحريات. وتتعدد أساليب إتصال المحكمة الدستورية العليا بالدعوى الدستورية فقد تتم وفق آلية الدفع من قبل الخصوم المقترن بالدعوى أو الإحالة من محكمة الموضوع كما يمكن للمحكمة ذاتها التصدي للمسألة من تلقاء نفسها، مع الإشارة إلى أن المشرع الدستوري المصري لم يفتح الباب أمام الأفراد بالطعن الدستوري المباشر أمام المحكمة الدستورية العليا. The Egyptian legislator constitutional has approved the establishment of an independent judiciary called the Supreme Constitutional Court, which is charged with overseeing the constitutionality of laws and regulations, The researcher aims through this study know how effective the mechanisms of control exercised by the Supreme Constitutional Court in order to ensure the respect for the principle of constitutional supremacy and protection of rights and freedoms. The Supreme Constitutional Court has a variety of methods and methods of communication with the Constitutional Court, which may take place in accordance with the mechanism of payment by the litigants associated or without dealing with the court of the subject The court itself can deal with the matter on its own, noting that the Egyptian constitutional legislator did not open the door to individuals to appeal Direct constitution in front of the the Supreme Constitutional Court.
