ألمصنف الرقمي وآليات حمايته في ظل القوانين المتعلقة بحقوق ألملكية ألفكرية

الملخص
يشهد عالم اليوم ثورة تكنولوجيّة رهيبة سيطرت على جميع مناحي الحياة العصريّة، أدّت الى قفزة نوعيّة مميّزة ،خاصّة مع تحول العالم الى قرية صغيرة بحكم العولمة، فضلا عن الاتحاد الذي نشأ بين تكنولوجيات الإعلام والإتصال وشبكة الإنترنت. ومن المجالات التي طالها هذا التطوّر حقوق الملكية الفكريّة عامة، والملكيّة الأدبيّة والفنيّة على الخصوص، حيث ظهر نوع حديث من المصنفات الأدبيّة تحت مسمىّ المصنفات الرقمية، هذه الأخيرة ذات طبيعة مختلفة عن المصنفات التقليدية، ويرجع سبب اختلافها الى كونها تعتمد على الوسائل التكنولوجية والبرمجيّات في إنشاءها وعملها. هذه المصنّفات الرّقميّة أصبحت محلّ اعتداءات وانتهاكات بسبب سهولة تداولها، نشرها وتوزيعها، كما وكيفا وفي مدة زمنية قصيرة، مما تولد عنه مساس واعتداء غير مشروعين على حقوق المؤلفين، ومعه صعوبة الكشف عن هذه الانتهاكات، مما أدى إلى ضرورة إيجاد ميكانزمات وآليات قانونية وتقنية، على المستوى الوطني والدولي لتوفير الحماية اللازمة. Abstract: The world of today is witnessing a terrible technological revolution that has dominated all aspects of modern life, which led to a distinct qualitative leap, especially as the world has turned into a small village by virtue of globalization, as well as the union that has developed between information and communication technologies and the Internet. Among the areas that affected this development are intellectual property rights in general, literary and artistic property in particular, where a modern type of literary works emerged under the name of digital works, the latter of a different nature from the traditional works, and the reason for their different is due to the fact that they depend on technological means and software to create them And her work.These digital works have become the subject of attacks and violations due to the ease of circulation, publication and distribution, in terms of quantity and quality, and in a short period of time, which results in an unlawful violation and attack on the rights of authors, and with it the difficulty of detecting these violations, which led to the need to find legal and technical mechanisms and mechanisms. National and international level to provide the necessary protection.
