جريمة تلويث المجالات المحمية بين الخطر والضرر

الملخص
المجالات المحمية منطقة بيئية ذات طبيعة خاصة تزخر بثروة نباتية هائلة، كما أنها ملاذ الطيور وبعض الحيوانات المهددة بالانقراض التي تتطلب توفير الحماية اللّازمة لمنع أي فعل يمس أو من شأنه أن يلحق الضرر بها أو بأحد عناصرها، إلّا أنّها لم تسلم من آثار مختلف الجرائم وعلى رأسها تلك المتعلقة بالتلوث، التي تصيبها بحد ذاتها، كما قد تنعكس على الكائنات الحية الموجودة بها، محدثة بذلك نتيجة إجرامية ذات أضرار هائلة. والهدف من هذه الدراسة معرفة مدى أهمية توسيع نطاق الضرر للتقليل من جرائم تلويث المجالات المحمية، أم أنه يجب الاعتماد على الخطر لمواجهة هذه الجرائم، وقد وتبين لنا نجاعة هذا الأخير في التقليل من جرائم تلويث المجالات المحمية كونه يحقق الوقاية اللازمة للمجالات المحمية وللبيئة ككل، ويحول دون تدهور عناصرها وفقدانها. Abstract: Protected areas are ecological regions of a special nature rich in tremendous plant wealth, and they are a sanctuary for some birds and animals threatened by extinction..Such wealth requires a special protection to prevent any damage may harm it and any of its elements. However, these regions are exposed to several risks, especially those related to pollution, which have caused enormous damage and created criminal consequences. The aim of this study is to find out how important it is to expand the scope of the damage to reduce the pollution of these protected areas, and to look for effective ways and useful sollutions in dealing with this kind of crimes. We have shown the effectiveness of reducing crimes of pollution and its necessity for the environment as a whole to prevent the deterioration of its elements.
