الأنظمة الإدارية الوقائية لتسيير المجالات المحمية وحماية العقار البيئي في التشريع الجزائري

الملخص
تعد المجالات المحمية من المواضيع التي أصبحت تفرض نفسها بقوة في الوقت الحالي لكونها من أهم العناصر المكونة للبيئة، إلا أن هذه المجالات تعرضت للتخريب بفعل سلوكيات الإنسان اللامسؤولة، الأمر الذي أدى إلى البحث عن التدابير والآليات الكفيلة بحمايتها من هذه الانتهاكات، ولعل من أبرز هذه الوسائل الفعالة لتسييرها نجد الآليات الإدارية الوقائية كنظام الترخيص، التصنيف والحظر، حيث تلعب هذه الوسائل دورا مزدوجا فهي تساهم في المحافظة على البيئة والمجالات المحمية من جهة، وتضمن من جهة أخرى الحماية الفعلية للعقار البيئي بالنظر لارتباطه بهذه المجالات المحمية. Protected areas are among the subjects that have strongly imposed themselves at the present time as they are among the most important components of the environment, but these spaces have been sabotaged by irresponsible human behavior, which has led to research measures and mechanisms, because they contribute to the preservation of the environment and protected areas firstly, and on the other by the guarantee of effective protection to the environmental real estate with a view. Among the most important of these effective means to make it work are preventive administrative mechanisms, such as licensing, classification and prohibition, because these means play a dual role to protect them from such violations, and perhaps one of the most to its association with these protected areas.
