أثر عمل الزوجة على حقها في النفقة بين الاختلاف الفقهي والفراغ التشريعي

الملخص
ملخص: تعتبر النفقة الزوجية، من أهم الآثار المادية المترتبة على عقد الزواج، بحيث تعتبر حقا أصيلا للزوجة أقرته الشريعة الإسلامية وحذت حذوها قوانين الأحوال الشخصية العربية من بينه قانون الأسرة الجزائري،فموضوع النفقة الزوجية موضوع مرتبط بالحياة اليومية للزوجين، لذلك يتأثر بظروف وأحوال الزوجين ، ومن الظروف المستجدة والتي انتشرت كثيرا في عصرنا الحالي عمل المرأة ،الذي أثار ومازال يثير عدة نزاعات بين الزوجين حول نفقة الزوجة ما إذا كانت عاملة. كلمات مفتاحية: نفقة، سقوط، عمل، زوجة، أثر، حق. Abstract: The alimony is considered as one of the most important material effects of the marriage contract, so that it is considered an authentic right of wife, which is recognized by the Islamic law and also by the family laws of the Arab countries, including the Algerian family law. The issue of alimony is a matter related to the daily life of the couple, so it is influenced by the circumstances and conditions of the couple, and from the new circumstances that have spread in our present day the work of women, which raised and still raises several disputes between the spouses about the wife's expense whether it is working.
