الملخص
من خلال مقال "تطوّر تملّك الأرض بإفريقيّة بين الظرفيّة التاريخيّة والتشريعات من خلال نوازل البرزلي 9ه/ 15م" حاولنا إبراز الدور المهمّ الذي تؤدّيه المدوّنة الفقهيّة في التأريخ لمعلومات هامّة تعالج الحياة اليوميّة وممارسات الفاعلين الاجتماعيّين ورهاناتهم. كما حاولنا تبيّن علاقة ظرفيّة القرن التاسع هجري/ الخامس عشر ميلادي بتصاعد أهميّة استغلال الأرض وتملّكها سواء من طرف السلطة الحفصيّة من أجل تعويض خسائرها الناتجة عن تقلّص التجارة البحريّة في البحر الأبيض المتوسّط، أو من طرف السكّان سواء من أجل الزراعة أو الرعي. فمن خلال دراسة تملّك الأرض في إفريقيّة (البلاد التونسيّة) خلال القرن التاسع هجري/ الخامس عشر ميلادي ومن خلال مدوّنة الفقيه أبو القاسم البرزلي (ت.803ه/1401م) "فتاوي البرزلي: جامع مسائل الأحكام لما نزل من القضايا بالمفتين والحكّاك" حاولنا تبيّن الظرفيّة التاريخيّة والقوانين المحدّدة لتملّك الأرض في زمن البرزلي ودور الممارسة الفقهيّة في شرعنة التملّك، وقد قسّمنا بحثنا إلى ثلاثة عناصر: - الظرفيّة التاريخيّة - القوانين المحدّدة لتملّك الأرض في زمن البرزلي - الأرض والحياة اليوميّة Through the article "The possession of land in Africa developed between historical circumstance and legislation through the cataclysms of al-Barzali BC. 9 AH / 15 A.D.", we have tried to highlight the important role that the Code of Jurisdiction plays in history important information dealing with daily life and the social practices and challenges of social actors. We also tried to show the circumstantial relation of the 9th century AH / 15th century AD with the increasing importance of the exploitation of the land and its property, either by the Hafsid authority in order to compensate for its losses resulting from the contraction of maritime trade in the Mediterranean, either by the population, whether for agriculture or pasture. By studying land ownership in Ifriqiya (Tunisia) in the 9th century AH / 15th century AD and through the blog of the lawyer Abu al-Qasim al-Burzuli (d. 803 AH / 1401AD) "Fatwas al-Barazli: questions of collection decisions about muftis and historical itching ”, we tried to show The specific laws of land ownership at the time of Burzuli and the role of legal practice in the legalization of property, and we divided our research into three elements: - Historical circumstance - The specific laws of land ownership at the time of the Burzuli - Earth and daily life
