الملخص

الملخص: تعتمد الدول المتقدمة في قوتها الاقتصادية بدرجة كبيرة على الشركات وذلك بتفعيل دورها في النشاط الاقتصادي، اذ هي كثیرة الانتشار في الحیاة العملیة یقبل علیها أصحاب المشروعات بشتى انواعها، رغبة منهم في أن تتخذ مشروعاتهم شكل الشركات التي یحتفظون بإداراتها وتكون مسؤولیتهم محددة بقدر حصصهم، حيث ميز الفقه والتشريع في تصنيفة بين الشركات التجارية تبعا لخصائصها والمقومات التي تقوم عليها كل شركة من شركات اشخاص و شركات اموال وحتى شركات مختلطة وهذا نظرا الى طرق تنظيمها والآثار المترتبة عليها، والاعتبارات التي تقوم عليها الشخصیة او المالية و مدى فاعلية كل اعتبار في شكل الشركة، وعليه فالاعتبار الشخصي في شركات الاشخاص هو معيار له اهمية دور كبير سواء فيما بين الشركاء او الغير لكونه يصاحبها من تأسيسها الى القيام بنشاطها وصولا الى تصفيتها و انقضائها. Abstract : Developed countries depend mainly in their economic power on companies when they activity their important role in the economic activating. Companies are so common in working life That Project owners of all sorts come to then in order to shape their projects into companies and leap their management and responsibility to the extent their shares allow. jurisprudence and legislation distinguish between trading companies when classifying them according to the characteristics and the constituents each one such as partner ships, trusts or mixed companies in view of the ways they are organized their Implications, their financial and personal consideration and the efficiency of each consideration in shaping the companies as for the personal aspect in par internships and its great Importance between companies or third parties, this aspect accompanies the company from foundations and activity to its liquidation.
