الملخص
ملخص تهدف هذه الدراسة لبيان تقنين أحكام الأسرة في الجزائر وباقي دول المغرب العربي، ومدى توفيقها بين التشريع الإسلامي ومتطلبات الواقع، واتبعت في هذا الموضوع المنهج التحليلي لقوانين الأحوال الشخصية في هذه الدول، التي سعت بعد الاستقلال لوضع تشريعات منظمة للأسرة وكانت في مجملها متوافقة مع الشريعة الإسلامية عدا بعض أحكام مجلة الأحوال الشخصية التونسية. خلال القرن الواحد والعشرين وتحت تأثير الظروف المستجدة والالتزامات الدولية تم إدخال عدة تعديلات على قوانين الأحوال الشخصية المغاربية. وفي الواقع مازالت الضغوطات الداخلية والخارجية متواصلة الأمر الذي يقتضي حفظ مقومات الأسرة المغاربية وإسناد عملية التقنين للعلماء المتخصصين القادرين على التوفيق بين المستجدات الواقعية ومقتضيات الشريعة الإسلامية. Abstract this study aims to clarify the rationing of the family provisions in Algeria and Other Maghreb countries, and their compatibility between Islamic legislation and the requirements of reality. I followed in this topic analytical method of personal status laws in these countries, Which sought after the independence to enact legislation to regulate the family, which in general were compatible with Islamic law, except some provisions of Tunisian Personal Status magazine . During the twenty-first century, and under the influence of new circumstances and International obligations, several amendments have been introduced to the Maghreb personal status laws. In fact internal and external pressures remain continuous, which requires the preservation of the components of the Maghreb family and assignment of the rationing process for the specialized scientists, who are able to reconcile the real developments with the requirements of Islamic law.
