الملخص
بسط المشرع الجزائري رقابته الإدارية على القرارات الإدارية الصادرة عن المصلحة المتعاقدة أثناء المرحلة التمهيدية لإبرام عقد الصفقة العمومية، والتي تكون منفصلة عنه، بأن ضمن للمتعامل المتعاقد ولغيره حق الطعن بموجب تنظيم الصفقات العمومية وتفويضات المرفق العام، أمام لجنة الصفقات العمومية المختصة ضد هذه القرارات، وأعمل رقابته القضائية بأن مكّنه من كافة حقوق الطعن المقررة بموجب التشريع المعمول به، والسماح من خلالها للقاضي الإداري بفحص مشروعيتها، وجواز قبول الطعن فيها بالإلغاء لإساءة استعمال السلطة. The Algerian legislator has extended its administrative control over the administrative decisions made by the contracting authority during the preliminary stage of conclusion of the Public Market contract, which is separate from it, and which the contractor and other persons have the right to make. Appeal of the regulation of public Markets and public service delegations Before the public transactions committee competent against these decisions, and uses its judicial control to allow it to benefit from all the rights of recourse prescribed by the legislation in force, allowing the administrative judge to examine its legitimacy, as well as the possibility to make appeal of the suppression of the abuse of power.
