الملخص

لقد أصبح نظام الحالة المدنية يحتل مكانة أساسية في حياة الأفراد بصفة خاصة والمجتمع و الدولة بصفة عامة، ذلك لأهميته في تنظيم حالة الأفراد من كل الجوانب سواء ما تعلق بالأهلية القانونية أو الحرية والمواطنة أو الحقوق والواجبات ...الخ. ومن هنا وجب السهر والوقوف على هذا المرفق من أجل تلبية حاجات المواطنين وتقديم الخدمات لهم بصفة مستمرة ومنتظمة، هذا الأمر لا يتأتى إلا بوجود ضابط الحالة المدنية، والذي يعتبر الحلقة الأهم في هذا النظام بإعتباره المسؤول الأول عنه، غير أن المشرع الجزائري ومن خلال مختلف القوانين الخاصة بهذا النظام لم يعرف لنا ضابط الحالة المدنية بل إكتفى بالنص على من لهم هذه الصفة فقط. ومن بين الذين ذكرهم المشرع الجزائري خاصة في القانون 14-08 نجد الأمين العام للبلدية، حيث كلفه بتسيير مرفق الحالة المدنية بصفة مؤقتة وفي حالات محددة The civil status system has become a central place in the lives of individuals in particular, society and the state in general, because of its importance in regulating the situation of individuals from all walks of life, whether it is legal capacity, freedom, citizenship, rights and duties... Etc. Hence, it is necessary to watch and stand on this facility in order to meet the needs of citizens and provide services to them on a continuous basis, this can only be achieved by the presence of the civil status officer, which is the most important link in this system as the first responsible for it, but the Algerian legislator and through various forces The civil status officer didn't know us. Among those mentioned by the Algerian legislator, particularly in Law 14-08, is the Secretary-General of the Municipality, who has tasked him with running the civil status facility temporarily and in specific cases.
