Le Mariage De La Personne Enlevée Avec Son Ravisseur Comme Une Excuse D’impunité En Droit Algérien

Résumé
Abstract: Abduction crimes against persons are considered to be one of the most serious crimes affecting the freedom of persons, because the victims are transferred from their natural environment to a new one , the seriousness of this crime increases if the victim is a minor, And even more so if the minor is a female, because of their natural weakness as well as the occurrence of sexual assaults , because even if they are not subjected to any attack, the view of the society to the kidnapped woman is not merciful. On this basis, the legislator included the impunity, in order to motivate the offender to amend his wrong doing in consideration to the interest of the minor who is abducted, which is the marriage of the kidnapper to the minor who is abducted as an obstacle to the criminal prosecution. In this article, we will attempt to shed the light on the concept of the crime of kidnapping through the statement of its elements, and then follow it with a statement of the nature of the impunity and its justifications and criticism. ملخص باللغة العربية: تعتبر جرائم الخطف الواقعة على الأشخاص من أخطر الجرائم التي تمس بحرية الأشخاص، لما في ذلك من نقل لهم من البيئة والمحيط الطبيعي الذي يعيشون فيه، وتزيد خطورة هذه الجريمة إذا كان ضحيتها قاصر، والأشد من ذلك أن تكون القاصر أنثى، نظرا لضعفها الطبيعي وكذا وقوعها عادة ضحية الاعتداءات الجنسية، وحتى إن لم تتعرض لأي اعتداء فإن نظرة المجتمع لا ترحم. وعلى هذا الأساس جاء المشرع بمانع من العقاب في هذا الخصوص تحفيزا للجاني ومراعاة لمصلحة القاصرة المختطفة، وهو زواج المختطف من القاصرة المختطفة ولا يكون محل متابعة إلا من قبل لهم مصلحة في إبطال الزواج. ونحاول من خلال هذا المقال التركيز مفهوم جريمة الاختطاف من خلال بيان أركانه، ثم نتبع ذلك ببيان ماهية المانع من العقاب ومبرراته والانتقادات الموجهة له.
