الأمانة العلمية في ضوء الشريعة الإسلامية والقانون الجزائري Scientific Secretariat In The Light Of Islamic Law And Algerian Law

الملخص
الأمانة سلوك قويم لإنسان سوي مستقيم، بحيث إنه يراعي في جميع شؤونه حدود غيره وحقوقهم فلا يعتدي ولا يستولي على ما ليس له عليه حق، وهذه الأمانة من الأخلاق القرآنية الراقية ومن الفضائل النبوية العالية، فهي رتبة ومنزلة تليق بذوي النفوس الزاهرة والأفئدة الطاهرة، وهي من الواجبات الشرعية التي يتحلى بها كل شخص مهما كانت مكانته أو وظيفته أو منصبه. والشريعة والقانون يلزمان جميع الناس بالأمانة في كل شؤونهم، وفي مجال البحث والتأليف والكتابة بالخصوص يلزمان الطلبة والباحثين بالنزاهة في النقل وبوجوب عزو الأقوال إلى أصحابها والأفكار إلى معتصريها، ونصوص الكتاب العزيز والسنة المطهرة في هذا المجال كثيرة، وفي القانون الجزائري يعتبر القرار الوزاري رقم 933 المؤرخ في 28 جويلية 2016 الذي يحدد القواعد المتعلقة بالوقاية من السرقة العلمية ومكافحتها العمدة في منع وتجريم السرقة العلمية. وقد برزت الأمانة العلمية في المجتمع المسلم منذ بدء الوحي مرورا بكتابة الوحيين في عصر النبوة والخلافة الراشدة وما بعدها، وبرزت كذلك عبر سلوك علماء الأمة عبر الأزمان المتعاقبة جيلا بعد جيل، وهي خصلة حميدة يتحلى بها الفضلاء في كل حين، وبالخصوص طلبة العلم والباحثين من أجل ازدهار علمي مميز، بعيدا عن التواكل والغش والخديعة، بحيث يبني كل شخص أمجاده بما يعتصره من أبحاثه وبما يجود به قلمه، لا بما يناله خلسة من عند غيره. Abstract Honesty is a straight behavior of a human being So he takes in all his affairs into account the limits of others and their rights He does not attack or seize anything He has no right, and this honesty is in High Quranic ethics and High prophetic virtues, it ranks The person And placed among bright souls And pure ones, which are from Duties of legitimacy Every person no matter his status, job or position. The Islamic law and Algerian law require all People in all their affairs Research and writing in particular students And researchers with integrity in transport And to attribute the words to their owners Ideas to their introspection, and texts Of the holly Quran and Sunnah in This field is many, and in the Algerian law from the ministerial decision No 933 of JULY 28 2016 Which sets the rules for The Prevention of scientific theft And the mayor in preventing and criminalizing Scientific theft. The Scientific Secretariat has emerged in The Muslim community since the revelation began Through the writing of the prophets in the ageof Prophecy and the adult succession and beyond It also emerged through the behavior of scientists The nation through successive generations After a generation, it is a good trait , Which the venerates always have Especially students of science and researchers For a distinguished scientific prosperity, far away , On dependence and cheating and deceit So that each person builds his glory He is surprised by his research and what he finds His pen, not what he steals from from others.
