نحو نظرية إجرائية لتفعيل دور الأمن والتعاون الدوليين في مواجهة الجريمة المنظمة

الملخص
بالنظر إلى جسامة وخطورة الأفعال الإجرامية - بعنوان الجريمة المنظمة - على السلم والأمن الدوليين، وعلى استقرار الدول و المجتمعات، فقد أصبح لزاما بل من الضروري استعانة الدول ببعضها البعض، وكذا المنظمات الدولية والإقليمية الحكومية وغير الحكومية المتخصصة منها وغير المتخصصة، إلى جانب الأجهزة الأمنية، كل ذلك ينبغي له أن يقف صفا واحدا ونسيجا متماسكا، يتم من خلاله حشد الجهود والطاقات الوطنية والدولية جميعها لمواجهة جرائم من نوع جديد، من حيث القوة والأسلوب والنطاق، ولا يكون ذلك إلاّ من خلال مقاربة التعاون الدولي والأمني في ظل نظرية إجرائية فعاّلة، ينبغي تحيينها وتطويرها وفق منظومة قانونية واضحة المعالم، ناظمة لمعدلة التوازن بين المتطلبات الداخلية للدول، والمتغيرات الدولية، يفعّل بها التعاون الدولي والأمني في مواجهة الجريمة المنظمة، والتي تعتبر من أخطر التهديدات على السلم والأمن الدوليين. Because of the dangerous criminal acts entitled «The Organized Crime «on the international peace and security, and the stability of countries and societies, working together and helping each other becomes an obligation and a necessity for all countries and so on for the international organizations and regions whether they are specialists or not, besides services of security. All these must be arranged harmoniously on the same line to mobilize their national and international efforts to fight crimes of new types through power, style and field. This will never happen without the international cooperation and security under an effective theory, that must be prepared and developed according to a well-defined juridical system which balances between the internal requirements of countries and the international changes to make the international cooperation and security more effective to fight the organized crime which is considered from the most dangerous threats on the international peace and security..
