We knew that the legislator imposes certain penalty for each act is considered a crime. This penalty is ranging between two limits a minimum and maximum limit. The legislator normaly leaves a discretion to the judje to give his verdict between these two limits, in an attempt to apply a punishement commensurating the personality, age health, psychological and social status of the delinquent. There is may be two persones committing the same criminal act, but in their treatment, the judge may find that every one has his own circumstances, and accordingly he deserves a different penalty. Even more – if certain circumstances happened to be existed – he may give him the minimum limit, and this what is called the attenuating circumstances.
