عوامل تحديد معنى المصطلح الفقهي

الملخص
ملخص : من المصطلحات الفقهية ما له معنى واحد لا يختلف باختلاف الأحوال ، ومنها يختلف معناه تبعا لعوامل متعددة ، وهذا البحث يهدف إلى استقراء هذه العوامل وبيان أثرها في تحديد معنى هذا النوع من المصطلحات . ومن أهم النتائج التي توصل لها البحث أن هذه العوامل تتمثل في اختلاف معنى بعض المصطلحات باختلاف ورودها في الأبواب الفقهية ، وكذلك اختلاف معناها في حال الإطلاق عنه في حال التقييد ، وأيضا اختلافه باختلاف المذاهب الفقهية في الألقاب والأحكام والشروط ، والاختلاف في المعنى باختلاف الزمن ، والاختلاف في المعنى تبعا لاختلاف اصطلاحات المؤلفين في كتبهم . وتم التمثيل على أثر كل عامل من هذه العوامل في تحديد معنى المصطلح بعدد من المصطلحات . وأوصى الباحث بالتأكيد على أهمية التعرف على معنى المصطلح الفقهي بدقة في الموضع والحال الذي ورد فيه نظرا لاختلاف معاني بعض المصطلحات الفقهية تبعا للعوامل السابق ذكرها ، وبيَّن ما يساعد على هذا التعرف . Abstract : Of the terms of jurisprudence, which has one meaning is not different depending on the circumstances, and the various meanings vary depending on multiple factors, and this research aims to extrapolate these factors and indicate their impact in determining the meaning of this type of terminology. The most important results of the research are that these factors are the difference in the meaning of some terms according to the difference in the chapters of jurisprudence, as well as the difference in the meaning of the release in case of restriction, and also different according to the doctrines of jurisprudence in titles and terms and conditions, and the difference in meaning according to time, In the sense according to the different conventions of the authors in their books. The effect of each of these factors on the meaning of the term was represented by a number of terms. The researcher stressed the importance of recognizing the meaning of the term of jurisprudence in the exact position and the situation in which it was stated because of the difference in the meanings of some of the terms of jurisprudence depending on the factors mentioned above, and what helps to identify this.
