الملخص
يعد قانون المنافسة قانونا ردعيا إذ يعاقب كل تصرّف مقيّد للمنافسة في السوق من خلال العقوبات الصارمة المُقّعة من طرف مجلس المنافسة بعد قيامه بالتحقيقات اللازمة. وتُفتح إجراءات التحقيق في مجال الممارسات المقيّدة للمنافسة من خلال إخطار مجلس المنافسة من قِبل الهيئات المعنيّة أو من خلال الإخطار التلقائي لمجلس المنافسة إذ يحقّ له فتح التحقيقات دون انتظار إخطاره من قِبل الجهات المعنيّة حتى يتمكّن من إيقاف الممارسات المحظورة قبل تأثيرها على المنافسة في السوق. The Competition Law is a deterrent act, as any conduct restricted to competition in the market is punishable by strict penalties imposed by the Competition Council after conducting the necessary investigationsThe investigation procedures in the area of restrictive practices shall be opened by notification to the Competition Council by the relevant authorities or through the automatic notification of the Competition Council. It shall be entitled to open investigations without waiting for notification by the concerned authorities to stop prohibited practices before they affect competition in the market
