الملخص
: الملخص إن السلطة المقيدة للإدارة في القرار الإداري هي نموذج ناجع وامثل لحماية الحقوق و الحريات العامة نتيجة تحديد المشرع لاختصاصاتها بشكل دقيق،مع التضييق على إرادتها منعا لانحرافها و تجاوزها، وذلك . يعد أكبر ضمانة للأشخاص تجسد استقرار المعاملات والعدل والمساواة، كما أن السلطة المقيدة ضرورية للإدارة لاستمرارها وحسن سيرها، بحيث يتم تنفيذ النص من طرفها بشكل بسيط و سهل وآلي Abstract The administration enjoys a restricted power in the administrative decision, and this is deemed as a successful and exemplary model in terms of the rights and collective liberties; and this is due to the accurate determination of its competences by the legislature , the restriction upon the will of the administration is ruled to prevent its deviation and excessive behavior ,and this considered as me of the greatest guarantees for persons ,and contributes to the stability of relationships ,equity and equality , the restricted power is as well necessary for the continuity of the administration ,its fractioning ,in a way to allow the execution of the law in a simple and easy way.
