دور الهيئة العليا المستقلة لمراقبة الانتخابات في الإشراف والرقابة على العملية الانتخابية في الجزائر

الملخص
عاشت الجزائر قبل التعديل الدستوري الأخير لسنة 2016 عدة تجارب هدفها مراقبة العملية الانتخابية والإشراف عليها ، ومن بينها إشراف السلطة التنفيذية بنفسها وخلق لجان مستقلة لمراقبة الانتخابات متكونة من ممثلي الأحزاب ولكن رغم ذلك بقيت العديد من الجهات وخاصة المعارضة تنادى بوجوب اللجوء الى جهة مستقلة كباقي الدول الديمقراطية الأخرى ، فاستجيب لرغبة هؤلاء وعمدت الدولة الى خلق هيئة عليا مستقلة للإشراف على الانتخابات،الغرض منها تنظيم انتخابات حرة ونزيهة ،فكانت لها اول تجربة مع الانتخابات التشريعية 4 ماي 2017 ،وسخرت إمكانياتها المادية والبشرية للوصول الى انتخابات ديمقراطية بدءا إعداد القوائم الانتخابية الى غاية ظهور النتائج النهائية ، وتتمتع بصلاحيات عامة في مجال رقابة الانتخابات عن طريق إخطار بعض الجهات المنصوص عليها في قانون الهيئة ، وكذلك لها ان تتدخل تلقائيا عند ملاحظتها لأي تجاوز يمس بشفافية ونزاهة العملية الانتخابية ، وكملاحظة مسجلة لعمل الهيئة انها مازالت تحتاج الى دراسة وتتفحص لاسيما ما يتعلق بتكوين أعضاءها . Abstract: Before the 2016’s constitutional amendment, Algeria had experienced a lot of in the field-observing and monitoring of variety of elections as in the executive branch’s implementation of election procedures as well as the creation of independent election monitoring committees consisting of representatives of the political parties . Nevertheless, many parties, particularly the opposition have called for some independent bodies ,as adopted in the democratic countries . In response to the opposition’s request, the state created an independent high electoral commission whose purpose is to administer a credible and fair election. The first experience of this very body was with the legislative elections of May 4th , 2017 . It exploited all its means and human resources for a democratic election , from the preparation of the electoral lists to the announcement of the final results . The body is competent , in election monitoring, to inform –upon notification- some of the parties as stipulated in the law herein . And can intervene ex-officio in the case of any excess that undermines the credibility of the electoral process . However, it is noted that this electoral body still needs enhancement mainly the way its members are appointed .
