السلطة الوطنية المستقلة للانتخابات وتمييزها عن الهيئة العليا المستقلة لمراقبة الانتخابات

الملخص
اضطر المشرع الجزائري أمام ضغط الحراك الشعبي الكبير، الذي أصبح يشكك في كل مخلفات النظام السابق، وتهديده المستمر لمقاطعة الانتخابات الرئاسية الأخيرة، إلى انشاء سلطة وطنية مستقلة للانتخابات على أنقاض الهيئة العليا المستقلة لمراقبة الانتخابات. وقد توصلنا إلى أن المشرع وفق نوعا ما في تعزيز استقلالية السلطة الوطنية المستقلة، مقارنة بالهيئة السابقة لها، وما نجاحها في تأطير الانتخابات الرئاسية الأخيرة، نسبيا، إلا خير دليل على ذلك، وإن كان نظامها القانوني لا يزال يحتاج إلى مزيد من التحيين والتنقيح، تحقيقا لشفافية ومصداقية أكبر في أدائها لمهامها. The lack of confidence of the electorate body in the integrity of the electoral process, and in front of the pressure of the large manifestations which has become suspicious in all the leftovers of the former regime, and its constant threat to boycott the last presidential elections, the Algerian legislator has been forced to establish an independent national authority for the elections to replace the independent supreme commission for elections observation. we have concluded that the legislator is somewhat according to strengthening the independence of the authority An independent patriot, and its success in framing the last presidential elections is relatively good evidence for that, although its legal system still needs more updating and revision, in order to achieve greater transparency and credibility in the performance of its tasks.
