The First Stability Of Al-maliki Doctrine الاستقرار الأولي للمذهب المالكي

الملخص
الاستقرار الأولي للمذهب المالكي يعتبر المذهب المالكي أكثر المذاهب أصولا جمع فيها بين الأثر و النظر، و حصره عند المتأخرين فيها به الفتوى مما نص عليه خليل بن اسحاق في متنه، ظلم بين للمذهب المالكي، و الأولى بالمفتي الرجوع إلى المذهب بمعناه الواسع. و قد سقت هذا المقال لإثبات أن الاستقرار الأولي للمذهب المالكي كان في بداية القرن الرابع على أقل تقدير و أثبت ذلك من خلال الدراسة التاريخية لمراحل تطور المذهب المالكي و بحث ثلاث مسائل و هي: - التبادل العلمي بين المدارس الفقهية المالكية. - الكتب التي ألفت في بداية دور التطور. - قاعة ترتيب المرويات. و تكمن أهمية المقال في لفت نظر الفقيه المالكي إلى بيئة خصبة من الأقوال المالكية مدعومة بأدلتها لينقل فتواه من خلالها بما يوافق زمانه و بيئته و يمنحه سعة في مصادره، بخلاف ما درج عليه المتأخرون من حصر المذهب فيما به الفتوى مما يضيق على المفتي و على مجموع الأمة. و أما رجوع المفتي إلى ما قبل فترة الاستقرار الأولي للمذهب المالكي فليس باليسير لأن المذهب فيها هو عبارة عن روايات و أقوال قد تكون متضاربة و ضبط موافقتها للمذهب و مخالفتها له أمر من الصعوبة بمكان خاصة في زمننا. And the Mufti back to the period before the first stability al-Maliki doctrine is not easy because of the doctrine of which is the novels and words may be contradictory and adjusting its approval of doctrine and breaking it is difficult especially in our time.
