ملخص : تناول هذا المقــال مسألة من مسائل الحكم التكليفي تتعلق بالندب ، حيث يُرجّح ترك المداومة على المندوب إذا خيف أن يترتب عليها اعتقاد الوجوب فيه . و لا شك أن انتفاء التسوية بين مرتبتي الواجب و المندوب أمر معلوم ، إذ لكل حكم شرعي خصوصية تميزه عن غيره ؛ لكن قد يعتري أفعال المكلفين ما يقتضي الترك ، فيُعمل بالاستثناء العارض ، و هو ترك المطلــوب ؛ جلبـا لمصلحة أو دفعـا لمفســدة . : summary This article treats an important issue , related whith the recommended rule ; so its likely to leave the continuity , when the belief of duy . leads to evil , and there is no doubt that the absence of a compromise between the rank of the duty and the recommended matter is known Every Charging legal law has its own distinctiveness ; however , the actions of legally commissioned persons may be subject to the requirement of leaving ; to applicate the obligatory speech to have an interest or avoid invalidity
