قواعد الترجيح عند الإمام الشاطبي

الملخص
ملخص : قضية الترجيح بين الأدلة و المصالح المتعارضة من أجلّ مسائل علم أصول الفقه و مقاصد الشريعة الإسلامية ، فبها يترقى النــاظر إلى أعلى رتب الاجتهـــاد و النظر، و هي الميـــــزان الدقيـــق لضبط الأحكــــام و مراتب الأدلة ، و درك منازل المصالح و المفاسد المتزاحمة. و قد تصدى أهل الخبرة و الفطنة لاستخلاص قواعــد الترجيح و ضوابطه ، و هي كثيــرة منتشرة يعسر حصرها ولـمُّ شتاتهـا ؛ نظرا لاتسـاع أبــواب الترجيـح و تشعبها. و تأتي هذه الصفحات لتعرض جملة من القواعــد التي اعتبرها الإمـــام الشـــاطبي أصولا مرجحة يُدفع بها التعــارض الظـــاهري بين الأدلــــة و المصـــــالح ، نحو خطوة مهمة لإضفاء فائدة تتعلق بمنهجه الفقهي و الاستدلالي . Summary The issue of preferring between the legal evidences and conflicting interests is one of the most important issues of principles islamic of jurisprudence , and the purposes of islamic law. It raises the mujtahid to the highest levels of ijtihad and consideration ,it is the accurate balance which adjust the rules and legal evidences ; to aware of interests and malicious evils .
