الحقوق والضمانات المقررة لحماية الأحداث الجانحين أثناء التحقيق وسير إجراءات المحاكمة -على ضوء القانون رقم 15/12 المتعلق بحماية الطفل–

الملخص
هناك العديد من الفئات المهمشة في المجتمع الجزائري والمجتمعات الأخرى، ومن بين هذه الفئات فئة الأطفال الذين يعانون من ظواهر عديدة، أهمها ظاهرة جنوح الأحداث وانحرافهم، وهي ظاهرة خطيرة تستحق التوقف عندها ودراستها، لأنها تعتبر من اعقد المشكلات الاجتماعية التي تواجه الدولة والمجتمع وتعرض مستقبل الأجيال للخطر الداهم. لذا كان لابد من ايجاد نظام منفصل كلياً للأحداث، بسبب خصوصية وضعهم وصغر سنهم وذلك من خلال إنشاء جهاز قضائي مستحدث من حيث الإجراءات، وهذا الأمر ينتج عنه إنشاء محاكم خاصة بالأحداث وهيئات ولجان متخصصة للنظر في قضاياهم، وهذا يعطي قدراً أعلى من المرونة والانفتاح في معالجة قضايا الأحداث، وهو ما أوصت به اتفاقية حقوق الطفل في المادة (40) فقرة (3)، من إقامة قوانين وإجراءات وسلطات ومؤسسات منطبقة خصيصاً على الأطفال الذين يدعى أنهم انتهكوا قانون العقوبات أو يتهمون بذلك أو يثبت عليهم ذلك. Abstract: There are many marginalized groups in Algerian society and other societies, and between these categories of children who suffer from many phenomena category, the most important phenomenon of juvenile delinquency and perversion, which is a dangerous phenomenon worthy of attention and study, because it is one of the most intractable social problems facing the state and society and offers future generations imminent danger. So it was necessary to create a separate system entirely to events, because of the specificity of their situation and their age and through the establishment of a judicial system novelty in terms of procedures, and this is resulting in the creation of special events and bodies and specialized committees to look into their cases courts, and this gives a much higher flexibility and openness in dealing with juvenile cases, which is recommended by the Convention on the rights of the Child in Article 40, paragraph (3), of the establishment of laws, procedures, authorities and institutions specifically applicable to children alleged as, accused of, or accused of, or recognized as havin.
