الملخص
الملخص: ترمي هذه الورقة البحثية إلى تبيان مدى العلاقة بين استغلال حقوق الملكية الفكرية والمركز المسيطر في السوق المعنية والقواعد التنافسية، من بعد ما أصبحت حقوق الملكية الفكرية هي محور التنافس إزاء الانفتاح والحداثة التي طرأت على النظام الاقتصادي، وهذا ما أثار العديد من الإشكاليات، خصوصاً في وجه من يريد الاستفادة منها، مما أوجب تدخل قانون المنافسة لضبط هذه الممارسات من أصحاب حقوق الملكية الفكرية وتتمثل في ضبط إساءة استغلال المركز المسيطر لهذه الحقوق في السوق المعنية. Abstract: abstract This research paper aims to show the extent of the relationship between the exploitation of intellectual property rights and the dominant position in the relevant market and competitive rules, after intellectual property rights became the focus of competition in the face of openness and modernity that occurred in the economic system, and this raised many problems, especially in the face of those who want to benefit from them, which necessitated the intervention of competition law to control these practices of intellectual property rights holders, which is to control the abuse of the dominant position of these rights. in the respective market
