الحمايـة القانونيـة للموارد المائية في ظل التشريع الجزائـري

الملخص
تكتسي الظاهرة المورد المائي أهمية بالغة، لما لها من أبعاد تؤثر على الحياة على وجه البسيطة بما فيها البشرية جمعاء و على بقاءها، فقد اتجهت الفكر البشري، ومن خلاله المجتمع الدولي وفي جميع المجالات إلى البحث فيها، ما أجل إيجاد الحلول الكفيلة بالتصدي لها. و لعل مجال التشريع بكل فروعه ليس بمنأى عن هذا الاتجاه، فالفقه القانوني يقسم بين الجانبين النظري الذي يهتم بالهندسة و الصياغة الدقيقة للقواعد القانونية، ليتلقاها الجانب التطبيقي و يفرغ محتواها لتطبيقها. و بين هذا و ذاك نجد وجوب البحث على الأهداف المتوخاة، و ذلك بالتقصي و البحث في آلية قانونية تجسد حقيقة الحماية للمورد المائي إن على المستوى الوطني بداية ثم على المستوى الدولي انتهاءًا، من خلال تكييف التشريع الوطني في كل دولة على حدة، بما يتناسب و يصب ككل في تشريع دولي موحد، سعيا منه لإيجاد الحلول لهاته الظاهرة و التصدي لها. Abstract: The phenomenon of the water resource is of great importance, because of its dimensions that affect life on earth, including all of humanity, and its survival. Human thought, and through it the international community and in all fields, have turned to researching it, in order to find solutions to address it. Perhaps the field of legislation in all its branches is not immune to this trend, as legal jurisprudence is divided between the theoretical sides, which are concerned with engineering and the precise formulation of legal rules, so that the practical side receives them and devotes their content to their application. Between this and that, we find the necessity of researching the desired goals, by investigating and researching a legal mechanism that embodies the reality of protection of the water resource, at the national level in the beginning and then at the international level in the end, by adapting the national legislation in each country separately, in a manner that is appropriate and It flows as a whole into unified international legislation, in an effort to find solutions to this phenomenon and address it.
