Abstract
This study deals with the subject of technical-scientific material evidence, which emanates from the opinion of the artistic or technical expert, is subject to scientific and laboratory examination, and is extracted using modern scientific methods and techniques that rely on research, scientific reports, and technical expertise to provide existing evidence in the criminal case and employ it in the field of criminal research to serve justice in its various stages, ancient, modern, and advanced. In pursuit of criminal justice تتناول هذه الدراسة موضوع الدليل المادى الفنى العلمى والذي ينبعث من رأي الخبيرالفني أوالتقني ويخضع للفحص العلمي والمعملى و يستخرج بواسطة أساليب و فنيات علمية حديثة تعتمد على البحوث والتقاريرالعلمية والخبرات التقنية لتقديم دليل قائم في الدعوى الجنائية وتوظيفه بمجال البحث الجنائى لخدمة العدالة بمراحله المختلفة القديمة والحديثة والمستحدثة المتطورة عبر الانترنت والحاسوب وشبكات التواصل( الدليل الجنائي الرقمي) بمراحله المختلفة القديمة والحديثة على مرالعصور حتى يومنا الحالى فى ظل تطبيقات الذكاء الاصطناعى الحالية ومايتوقع حدوثه فى المستقبل القريب بتقنية الميتافيرس تناولنا بالدراسة الدليل المادى الفنى العلمى مربمراحل عديدة متباينة على مدارالايام حتى يومنا الحالى فى ظل الكمبيوتر والانترنت والعالم الافتراضى وتقنية الذكاء الاصطناعى والميتافيرس والذى أصبحنا نلتمسه اليوم ويحيط بنا من خلال شبكات الانترنت واجهزة الحاسوب والهواتف الذكية، وغيرها من التقنيات والمنصات التي باتت تيسروتسيرحياتنا وتشكل خطورة على الافراد والمؤسسات والمجتمعات وتظهرهذه الدراسة اهمية الدليل المادى الفنى والدليل الرقمى بمسرح الجريمة و جرائم الانترنت الالكترونية باشكالها المتعددة وجرائم العالم الافتراضى وصورالانتهاكات التي تقع في تقنية الميتافيرس، في ضوء الفراغ التشريعي القائم في مواجهة كافة فلا شك في أن القوانين الجنائية الحاليَّة تكون مكتوفة الأيدي في مواجهة التطورات التكنولوجية المتلاحقة والتى لا يمكن التصدي لها جنائيًّا، إلا من خلال نصوص جنائية قائمة وقد واجهنا العدبد من المشكلات منها مشكلة جمع الأدلة العلمية باعتبارها عملية معقدة و شاقة للوصول للحقيقة والاعتراف وإنتزاع الحقيقة من البهتان والتى تفوق في بعض الأحيان الكفاءات والقدرات العلمية والخبرات التي يمتاز بها المحققون وذلك يراجع إلى إستخدام الجناة أحدث ما وصل إليه العلم في إقترافهم لتلك الجرائم المستحدثة وإستغلال محترفي الإجرام الوسائل المتقدمة والأدوات التقنية المتطورة في إرتكاب جرائمهم وخاصة الإجرام المنظم العابرللحدود والجرائم الالكترونية والمعلوماتية وجرائم الإنترنت والإبتزازالإلكترونى وسرقة البيانات وتمويل الإرهاب وغيرها من الجرائم الحديثة منها جرائم الموبايل وصولا الى جرائم الذكاء الاصطناعى والميتافيرس بالاضافة الى صعوبة حصرانواع تلك الجرائم المستحدثة وتحديد المجرم مرتكب تلك الجرائم ونجديد المستخدمين والمساهمين والاباطرة فى جرائم الميتافيرس المستحدثة والمرتقبة بالاضافة الى تعثرتطبيق التشريعات والقوانين نتيجة تسارع وتيرة ظهور وتعدد تلك الجرائم وتطورالجرائم والذى غالبا ما يسبق التشريع لكونه فى تسارع رهيب يهدد المجتمعات والافراد والمؤسسات كافة يحناج الى تعديلات تشريعية تواكب هذا التسارع الاجرامى الافتراضى الرهيب وضرورة إدخال وسائل جديدة حديثة في عملية إكتشاف الجرائم حتى يكون للسياسة الجنائية دورإيجابي وفعال في مكافحة الإجرام المستحدث وإستخدام تقنيات وطرق وأساليب وأدوات حديثة للتعرف والإستعراف على الأشخاص والجناة وكشف المستخدمين والمساهمين ومرتكبها ودراسة الية عمل مسرح الجريمة والبحث عن الأثاروأقامة أدلة الأثبات والأدانة وتقديم الجناة للقضاء وتطبيق العقوبات تحقيقا للعدالة الجنائية
