الملخص

ملخص: تهدف هذه الدراسة إلى إبراز أهم معالم منهج البحث الذي سلكه الشيخ محمود باي في تأليفه الأصولي؛ وذلك لما له من اهتمام بالتأصيل وقضاياه، خاصة فيم تعلق بالمذهب المالكي فروعا وأصولا، ويكون ذلك من خلال التعرّف على ما أمكن من سيرته وحياته العلمية والمهنية، وما خلفه من ثروة وآثار علمية في الجانب البحث الأصولي عند القرافي المالكي ابتداء وغيره تبعا، وكذا استقراء كتبه وبحوثه في علم أصول الفقه بغية استخراج المعالم والسمات العامة للمنهج الأصولي المالكي، وخاصة أن الإمام القرافي أكثر مشاركة في مباحث التأصيل في المذهب المالكي، وخلصت الدراسة إلى جملة من النتائج أهمها: أن الشيخ محمود باي سلك في تأليفه الأصولي طريقة المدرسة المالكية عموما، و جمع بين الأصالة والمعاصرة في التأليف، مظهرا ما عليه منهج ومعالم البحث الأصولي لدى المالكية حسب تطور فن التأصيل عبر التاريخ، وأيضا تبين أن الشيخ كان ملتزما في ذلك بمبادئ وأسس المنهجية العلمية والأكاديمية. Summary: This study aims to highlight the most important features of the research approach followed by Sheikh Mahmoud Bey in his book The Fundamentalist; This is because of his interest in rooting and its issues, especially in what relates to the Maliki school of thought, its branches and origins, and this is done through learning as much as possible of his biography, his scientific and professional life, and the wealth and scientific effects he left behind in the aspect of fundamentalist research according to Al-Qarafi Al-Maliki in the beginning and others subsequently, as well as extrapolating his books. And his research in the science of jurisprudence in order to extract the general features and characteristics of the fundamentalist Maliki school of thought, especially since Imam al-Qarafi was more involved in the investigations of rooting in the Maliki school of thought. The study concluded with a number of results, the most important of which is: Sheikh Mahmoud Bay followed in his fundamental writings the method of the Maliki school in general, and collected Between originality and modernity in writing, showing the methodology and features of fundamentalist research among the Malikis according to the development of the art of authentication throughout history, and also showing that the Sheikh was committed to the principles and foundations of scientific and academic methodology.
