أوجه الرقابة على البلديات "دراسة وصفية تحليلية خاصعة لأحكام القانون الفلسطيني"

الملخص
تعتبر البلدية هيئة محلية تتبع النظام اللامركزي في الدولة في إطار تنفيذ السياسة العامة للدولة، وتقوم البلدية بالعديد من الأعمال والوظائف في إطار بقعة جغرافية معينة، وأثناء ذلك قد تتقاعس أو ترتكب الأخطاء أو تنحرف عن المسار الذي رسمه لها القانون، وعليه تهدف هذه الدراسة إلى إلقاء الضوء على أوجه الرقابة التي تمارسها الجهات السياسية والقضائية والإدارية في فلسطين على البلديات في ضوء القانون الفلسطيني. وقد توصل الباحث إلى العديد من النتائج كان أبرزها أن البلديات في فلسطين تقع تحت رقابة المجلس التشريعي الفلسطيني من خلال توجيه الأسئلة والاستجوابات لوزير الحكم المحلي وتعد طرق غير مباشرة، كذلك يملك تشكيل لجان تقصي حقائق وقبول الشكاوى من المواطنين، كما يبسط القضاء الإداري في فلسطين رقابته على القرارات والعقود الإدارية التي تصدرها وتبرمها البلديات والتعويض عنها إن كان للتعويض مقتضى، وإلى جانب ذلك خصص القانون الفلسطيني جهات رقابية خارجية وإدارية متخصصة في الرقابة على السلطة الإدارية، كما يوجد بداخل كل بلدية دائر رقابية، مثل وحدة الرقابة الداخلية، ودائرة الرقابة العامة. ومن أبرز توصيات الدراسة ولتطوير الرقابة الإدارية الداخلية يتعين بداءة وضع الشخص المناسب في مكانه المناسب، وإنشاء وحدات متخصصة داخل كل منشأة بلدية غرضها رقابي استشاري فقط، وذلك لضمان سير العمل الإداري ضمن مبدأ المشروعية، مع إجراء انتخابات محلية في أقرب وقت ممكن. The municipality is a local body that follows the decentralized system of the state in the context of the implementation of the State's general policy and the municipality carries out many jobs and functions within a given geographical location. In the meantime, the municipality may fail, commit threats or deviate from the course laid down by law. This study aims to highlight the control practised by Palestine's political, judicial and administrative authorities over municipalities in the light of Palestinian law. The researcher has reached many findings, most notably that municipalities in Palestine are under the control of the Palestinian Legislative Council by directing questions and interrogations to the Minister of Local Government and are indirect methods as well as the establishment of fact-finding committees and the acceptance of complaints from citizens. The administrative judiciary in Palestine also extends its oversight of decisions and administrative contracts issued and concluded by municipalities and compensation if it is required. In addition, Palestinian law allocates external and administrative oversight bodies specializing in oversight of the administrative authority. Besides, within each municipality, there are also oversight districts, such as the Internal Oversight Unit and the General Oversight Service. One of the most important recommendations of the study and for the development of internal administrative control is to begin placing the right person in the right place, and to establish specialized units within each municipal institution for the purpose of advisory oversight only, so as to ensure the administration's functioning within the principle of legality, with local elections to be held as soon as possible
