الملخص
يتصدر الإجرام الواقع على البيئة قائمة الاهتمامات الدولية والوطنية، ويتجلى هذا الاهتمام في العديد من التصريحات والمؤتمرات، والندوات، فضلا عن البحوث والدراسات، المنددة به بدءا بقمة الأرض المنعقدة عام1992م ،والتي شكلت منعطفا حاسما على مستوى وعي الإنسان بخصوص حماية بيئته، بما تمليه أمانة الاستخلاف . وتهدف هذه المقالة إلى تسليط الضوء على هذا النوع من الجرائم؛ بسبب تداعياتها الخطيرة على تغير المناخ ،من خلال بيان مفهومها، وأنواعها، وأهم خصائصها، ثم العقوبات المقررة عليها وفقا للتقنين الجزائري، بغية الوقوف على مدى نجاعة هذه الوسائل في الحد منها؛ التي للأسف لم تفي بالغرض المطلوب بدليل تزايد حجم الاعتداء على البيئة. Environmental crime tops the list of international and national concerns, as evidenced by numerous statements, conferences, seminars, as well as research and studies condemning it. This concern has been evident since the Earth Summit held in 1992, which marked a pivotal moment in human awareness regarding environmental protection, dictated by the responsibility of stewardship. This article aims to shed light on this type of crime due to its serious implications for climate change. It will define its concept, types, and main characteristics, then outline the penalties prescribed for it according to Algerian legislation, in order to assess the effectiveness of these measures in curbing it. Unfortunately, these measures have not met the desired purpose, as evidenced by the increasing level of environmental degradation.
