وقف حقوق الملكية الفكرية

الملخص
الوقف نموذج متميز لا مثيل له، وهو دليل قوي على الحس التراحمي الذي يمتلكه المسلم تجاه إخوانه ومجتمعه، وهو ما تترجمه تلك الصور المشرقة التي سجلها الوقف عبر التاريخ الإسلامي الممتد؛ حيث كان دوره ملحوظًا في كثير من بلاد المسلمين بالمشاركة الفاعلة في التأثير في الحياة الثقافية، والصحية، والاجتماعية بشكل عام ،الأمر الذي دفع بالدول الإسلامية إلى إنشاء كيان خاص يُعنى بتطويره ، بعدما تبين لها مدى نجاعة هذا الوعاء كبديل اجتماعي، ورافد اقتصادي مهم لسد حاجات المجتمع. وإذ يلعب الوقف دورا هاما في مساندة اقتصاد الدولة وتعبئة مواردها ،تبقى العديد من مشاريعه الواعدة طيَّ النسيان أو عرضة للإهمال، ومن ذلك وقف حقوق الملكية الفكرية، الذي لا يزال دون التطلعات المنشودة ،مقارنة بالعوائد المالية التي يحققها لأصحاب هذه الحقوق، ومن ثم كان ولا بد من الاهتمام بهذا النوع من الأوقاف ، تأسيسا على ضرورة توفير موارد جديدة لتلبية الاحتياجات الاجتماعية القائمة ،وفي هذه الورقة عرض وبيان لموقف الشريعة والقانون من مشروعية وقف حقوق الملكية الفكرية، مدعوما ببعض الإحصائيات التقريبية. Endowment is a unique and unparalleled model, a strong evidence of the compassionate sense inherent in Muslims, reflected through the bright images recorded throughout Islamic history. Its role has been significant in many Muslim countries, actively participating in influencing cultural, health, and social life in general. This has led Islamic countries to establish a dedicated entity for its development, after realizing its effectiveness as a social alternative and an important economic resource to meet societal needs. While endowments play a crucial role in supporting the state economy and mobilizing its resources, many of its promising projects remain forgotten or subject to neglect. One such example is the endowment of intellectual property rights, which still falls short of expectations compared to the financial returns generated for the rights holders. Therefore, there is a necessity to pay attention to this type of endowment, aiming to provide new resources to meet existing social needs. In this paper, the stance of Sharia and law regarding the legitimacy of endowing intellectual property rights is presented and supported by some approximate statistics.
